Competitive Tech: Clarifies Status of Litigation

CTT Clarifies Status of American Home Products/Materna Litigation
Fairfield, CT (May 30, 2000) Competitive Technologies, Inc. (AMEX:CTT)
today clarified the status of litigation filed by the University of
Colorado Foundation, Inc., The University of Colorado, Robert H. Allen
and Paul A. Seligman, plaintiffs against American Cynamid Company (now
owned by American Home Products Corp. - NYSE:AHP) involving a patent for
an improved formulation of MaternaTM, a prenatal vitamin compound sold
by the defendant. Although CTT was not and is not a party to this case,
it had a contra ct with the University and thus is entitled to a share
of any judgment. In 1997, the Federal District court ruled in favor of
the plaintiffs and awarded approximately $44.4 million, of which
approximately $5.2 million would have been CTT's share. The case was
appealed by AHP and in November 1999, the United States Court of Appeals
for the Federal Circuit vacated and remanded the decision of the Federal
District court instructing the Federal District c ourt to determine
inventorship using federal patent law s tandards and then to determine
whether damages should be awarded. On February 29, 2000 the Federal
District court heard arguments on the plaintiff's motion for judgment.
The judge's ruling has yet to be released; accordingly, the matter
remains before the court. CTT has not recognized any potential judgment
proceeds since it is unable to predict the amount of any judgment, if
any.
In a separate matter, the U.S. Supreme Court, without comment, refused
to consider an appeal by the University of Colorado and two of its
scientists relating to copyright issues involved in this case. The U.S.
Supreme Court inaction on this copyright issue has no impact upon the
inventorship matter that is pending before the Federal District Court.
